InsMelo User Agreement
1. Acceptance of Terms
By using the Service, you agree to be bound by this Agreement.
2. Eligibility
You must be at least 13 years old to use the Service. If you are under 18, you must have the consent of a parent or legal guardian.
3. Account Registration
You agree to:
- Keep your account credentials confidential
- Notify us immediately of any unauthorised use of your account
4. Licence
We grant you a limited, non-transferable, revocable licence to access and use the Service in accordance with this Agreement.
5. Ownership
All intellectual property rights in the Service remain the property of Adelina Wu Pty Ltd.
You retain ownership of music you create using the Service, subject to Section 6.
6. Commercial Use
- Free / Creator plans: personal, non-commercial use only
- Pro Studio and higher plans: commercial licence for generated works
7. Restrictions
You agree not to:
- Reverse engineer, decompile, or attempt to extract source code
- Generate unlawful, harmful, or abusive content
- Resell, sublicense, or share access to the Service without permission
8. Payments, Upgrades & Refunds
Subscriptions are billed in advance and are generally non-refundable.
Upgrades
If you upgrade your subscription before the end of your current billing cycle:
- The unused portion of your current plan will be prorated
- A prorated refund or credit will be applied against the new plan charge
- You will only pay the net difference between plans
Proration Formula
Refund = Old_Price × (Remaining_Days / Total_Days)
Charge = New_Price − Refund
Any applicable refund amount will be returned to your original payment method and should appear within 3 business days, depending on your bank or payment provider.
Cancellations
You may cancel your subscription via the platform where you subscribed (e.g. App Store or Google Play) or by emailing us at least 72 hours before renewal to avoid being charged for the next billing period.
9. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind.
10. Limitation of Liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages. Our total liability is capped at the fees paid by you in the preceding 12 months.
11. Termination
We may suspend or terminate your access if you violate this Agreement. All licences granted to you end upon termination.
12. Changes
We may update this Agreement from time to time. Continued use of the Service constitutes acceptance of the updated terms.
13. Governing Law
This Agreement is governed by the laws of Australia.
